These Terms of Service (the "Terms") govern access to and use of the services provided by AskSiya Inc. ("AskSiya", "we", "us"): the asksiya.com website, the AskSiya dashboard, and the Siya AI phone receptionist (together, the "Service"). By creating an account or using the Service you agree to these Terms on behalf of yourself and the business you represent (the "Customer").
Siya is an AI voice agent that answers the Customer's configured phone line, converses with callers, and produces structured results such as food orders, room bookings, and messages, which are delivered to the Customer's dashboard and notification channels. The Service includes provisioning of a dedicated phone number and storage of call transcripts and results.
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Accounts are for business use; you must be authorized to bind the Customer.
New accounts receive a 7-day free trial that includes 30 minutes of live calls. No payment method is required to start. When the trial ends (by time or by minutes), Siya stops answering until a paid plan begins. Trial configurations are retained for 30 days after expiry.
You may cancel at any time from the dashboard. Service continues until the end of the current billing period. After closure, your data remains exportable for 30 days (see the Privacy Policy), and provisioned phone numbers are released on our standard schedule.
Siya is an automated system. She is designed to quote only from your configuration and to hand off to humans, but like any AI she can mishear, misunderstand, or make mistakes. The Service is not intended for emergency services or life-safety use. You should review transcripts and results and correct errors in the ordinary course of business.
We own the Service and its software. You own your business data - configurations, transcripts, orders, bookings, and messages - and grant us the licence needed to operate the Service on your behalf. Feedback may be used to improve the Service.
Our collection and handling of personal information, including call audio, transcripts, PIPEDA and GDPR matters, retention, and subprocessors, is described in the Privacy Policy, which forms part of these Terms.
We target high availability but the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Telephony depends on third-party carriers we do not control.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues (including orders or bookings not captured). Our total aggregate liability under these Terms is limited to the amounts you paid us in the 3 months before the event giving rise to the claim.
You will defend and indemnify AskSiya against third-party claims arising from your business's goods and services, your configuration, or your breach of the caller-consent obligations in section 6.
We may suspend or terminate accounts for non-payment, abuse, or breach of these Terms, with notice where practical. Sections that by their nature survive termination (including 8, 11, and 12) survive.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, and the parties attorn to the courts of Toronto, Ontario.
We may update these Terms; material changes will be announced to customers by email at least 30 days before they take effect. Continued use after the effective date is acceptance.
